1. Description of Services
FlavorTech provides a cloud-based software-as-a-service (SaaS) platform for restaurants and hospitality businesses. Our services include:
- Core Service (Digital Menu): QR-code generation, PDF menu hosting, Interactive Digital Menu interfaces, multi-language translation tools, data analytics, and POS (Point of Sale) system integrations.
- Add-on Service (AI Dish Photo): An artificial intelligence-driven image generation and enhancement tool designed to optimize food photography for digital menus.
2. Subscription Plans & File Hosting
We offer different tiers of subscriptions for our core Digital Menu product:
- FREE Plan: Includes 1 QR code and hosting for exactly 1 PDF menu file. The hosted PDF file is subject to size limitations (maximum 15MB) and will display a "Powered by FlavorTech" promotional badge.
- Paid Plans (Multi-PDF, Digital, Integrated): Fees are billed on a recurring monthly basis. Failure to process payment will result in account downgrading or service suspension.
- Content Responsibility: You retain all rights to the PDF menus and text uploaded to our servers. You are solely responsible for ensuring that prices, allergen information, and descriptions are accurate and compliant with local consumer laws.
3. AI Add-on Service & Credit System
The AI Dish Photo tool operates on a credit ("Колы") mechanism:
- Subscription Credits: Certain paid Digital Menu plans include a fixed monthly allocation of AI credits (e.g., 50 credits). Unused monthly subscription credits expire at the end of each billing cycle and do not roll over.
- Booster Packs (Pay-as-you-go): Users may purchase additional standalone credit packs. Credits purchased via Booster Packs do not expire and remain active on the account until consumed.
- Consumption Logic: One (1) credit is deducted from the user's balance per successful image generation. Modifications to the same source image within a 5-minute window do not consume additional credits.
4. Intellectual Property & AI Disclaimer
- Ownership: FlavorTech owns all rights, titles, and interests in the underlying technology, algorithms, software, and interfaces of both the Digital Menu and the AI tools.
- AI Output Accuracy: FlavorTech utilizes advanced machine learning models to enhance food images. We do not guarantee that the generated images will perfectly replicate physical dishes. The user assumes full responsibility for ensuring that AI-enhanced images used in their public digital menu do not mislead consumers regarding portion sizes, ingredients, or food presentation.
5. POS Integrations & Payments
For the Integrated plan, FlavorTech facilitates the synchronization between our interactive menu and third-party POS systems. While we strive for 100% uptime, we are not liable for any revenue loss resulting from network disconnects, API changes by POS providers, or payment processing delays from external gateways (Apple Pay, Google Pay, Stripe, etc.).
- Refund Policy: All subscription fees and standalone AI credit purchases are final and non-refundable.
6. Limitation of Liability
To the maximum extent permitted by applicable law, FlavorTech shall not be liable for any indirect, incidental, special, exemplary, or consequential damages, including loss of profits, data, or goodwill, arising out of or in connection with the use or inability to use our core menu systems or AI photography services.
7. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of major pricing or policy structural changes via email or dashboard announcements. Continued use of the platform after updates implies acceptance of the new Terms.
